§ 1 Scope
These terms apply to all services of Simon Blaschke Coaching, including one-on-one, couples, and leadership coaching, workshops, seminars, retreats, music-based formats, and digital products.

§ 3 Conclusion of Contract
(1) A contract is concluded by written agreement via email or by oral agreement with subsequent confirmation.
(2) Insofar as the provider makes an online appointment booking tool available, this serves exclusively to schedule appointments for coaching services that have already been agreed by contract. No separate contract is concluded via the appointment booking tool.
§ 4 Distinction from Psychotherapy
Coaching is not medical treatment and is aimed at mentally healthy individuals. In case of suspected therapeutic indication, the provider reserves the right to decline or terminate coaching.
§ 5 Prices and Payment
Valid prices are stated on the website, incl. statutory VAT. Payment is due before the start or as agreed within 14 days.
§ 6 Right of Withdrawal for Consumers
(1) Consumers (Section 13 of the German Civil Code, BGB) have a statutory right of withdrawal for contracts concluded by means of distance communication (Section 312c BGB) or off business premises (Section 312b BGB), in accordance with the withdrawal instruction below.
(2) There is no right of withdrawal for contracts that a consumer concludes in person on the provider’s business premises, nor in the further cases provided for by law (Section 312g(2) BGB).

Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period will expire after fourteen days from the day of the conclusion of the contract.
To exercise the right of withdrawal, you must inform us (Simon Blaschke, Strombergstr. 53, 74389 Cleebronn, Germany, email: coaching@simonblaschke.de) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or an email). You may use the model withdrawal form below, but it is not obligatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
If you requested to begin the performance of services during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated to us your withdrawal from this contract, in comparison with the full coverage of the contract.
Early Expiry of the Right of Withdrawal
(3) In the case of a contract for the provision of services, the right of withdrawal expires early if the provider has fully performed the service and only began performance after the consumer gave their express consent and at the same time confirmed their awareness that they would lose their right of withdrawal upon complete performance of the contract by the provider (Section 356(4) BGB).
(4) In the case of contracts for digital content not supplied on a tangible medium, the right of withdrawal expires if the provider has begun performance of the contract after the consumer has expressly consented to the provider beginning performance before the expiry of the withdrawal period, the consumer has confirmed their awareness that they thereby lose their right of withdrawal, and the provider has provided the consumer with confirmation thereof (Section 356(5) BGB).

§ 7 Cancellation
(1) An existing statutory right of withdrawal under Section 6 of these terms remains unaffected by the following cancellation provisions and takes precedence over them. Within the ongoing withdrawal period, a consumer may withdraw from the contract free of charge; the graduated scale under paragraph 2 does not apply in this respect.
(2) Otherwise the following applies: One-on-one coaching: free of charge up to 48 hours before, thereafter 50%, on the same day 100%.
Workshops/retreats: free of charge up to 30 days before, 29–14 days 50%, from 13 days 100%.
§ 8 Copyright
All concepts, methods, and materials are protected by copyright. The client receives a simple, non-transferable right of use.
§ 9 Confidentiality
All content shared in coaching is subject to confidentiality.
§ 10 Liability
Coaching outcomes are individual and cannot be guaranteed. Liability only in case of intent and gross negligence.
§ 11 Final Provisions
German law applies. Should individual provisions be invalid, the remaining ones remain in effect.
